THE MDC Director-General, Toendepi Shonhe, had his application challenging his illegal incarceration under the draconian Section 121 subsection (3) of the Criminal Procedure and Evidence Act referred to the Supreme Court at the Harare Magistrates’ Court today.
Shonhe wants the Supreme Court to determine the constitutionality of this colonial Section, which is being used by the Attorney-General’s (AG) Office to detain him and other MDC members who would have been granted bail by the courts.
Shonhe was arrested last week on trumped-up charges of perjury and is accused of having lied under oath when he swore to an affidavit that three members of the MDC had been re-abducted by State security agents.
He was granted a US$500.00 bail with stringent reporting conditions but the State invoked section 121 to annul his bail application.
Yesterday, High Court Judge, Justice Tendai Uchena also granted an application by four MDC activists to have their case referred to the Supreme Court where they will contest that their constitutional rights were violated when they were abducted by State security agents last year.
