The Zimbabwe government’s selective application of the law was exposed yesterday as it emerged that Police have been using a foreign registered vehicle seized from a Sky News crew to transport abducted civil society activists to and from court. It is illegal in Zimbabwe for anyone to drive a foreign registered vehicle in the absence of its registered owner.
The vehicle, a red VW minibus, together with television broadcasting equipment, laptops, computers, disks, and videotape was confiscated in May last year in Bulawayo, and three Sky employees were detained. Bernet Hasani Sono, Resemate Chauke and Simon Musimani were subsequently each sentenced to six months in jail. In July 2008 a High Court judge reduced the sentences to fines of Z$50 billion and they were deported.
The red VW minibus, with Gauteng registration plates HNL 223 GP, had been used so openly by the state to transfer the activists, some of whom allege that they have been tortured and beaten while in custody. Gauteng vehicle records show the vehicle to be the property of Kebone Tours and Transport, a tourism company based in Vorna Valley between Johannesburg and Pretoria, from whom Sky rented the vehicle. As Phetole Ramatseba of Kebone Tours said: “We haven’t really owned that vehicle since it was taken by the Zimbabwean state.”
Last year Police impounded MDC President Morgan Tsvangirai’s South Africa regestered vehicle on the pretext that it was illegal under the Customs and Excise Act for the opposition leader to use the vehicle in the absence of its owner who at the time had already returned to South Africa.
The armoured BMW X5 vehicle, confiscated by police in the run up to the disputed presidential elections now held in Bulawayo’s Drill Hall station.
The BMW X5 was impounded by police on 6 June when Mr Tsvangirai was detained for several hours at Esigodini police station in Lupane.
Instead police have charged a South African businessman with violating customs law after he donated an armoured vehicle to Tsvangirai for use during a June second round presidential election, controversially won by President Robert Mugabe.
The businessman, Adriaan Espag, brought the vehicle – a bullet-proof BMW X5 registered in South Africa – into Zimbabwe and gave it to Tsvangirai.

SALES at Dunlop Zimbabwe Limited have significantly improved since the company received a license entitling it to sell its products in foreign currency, says a report by the company.
The Reserve Bank of Zimbabwe granted Dunlop Zimbabwe the licence required for companies in the country to sell products using foreign currency in late November 2008.
Without releasing specific figures, company managing director Kennedy Mandevani said that sales have been steadily increasing.
“The FOLIWARS (Foreign Exchange Licensed Warehouses and Retail Shops) sales are gradually picking up and will make a positive difference to our sales mix,” said Mandevani.
“Dunlop is intensifying its marketing campaign so that more of our customers are made aware of this facility.”
The licence has allowed the tyre manufacturer to import more raw materials, which have made an increase in production capacity possible, “thereby improving the company’s viability and safeguarding the company’s employment base.”
“In addition, the more we sell in forex, the more forex that is made available to the RBZ to finance crucial national programmes in the country,” stated Mandevani.

Bishop Paul Verryn heads the Methodist Church in Johannesburg where he has welcomed thousands of Zimbabwean refugees.
He has been appalled by their stories.
“We are witnessing a slow genocide in Zimbabwe . And what will it take for the international community, West, East and African, to come to the place where we say, ‘That’s it’?” he said.
“This is a bunch of thugs and a gang that is ruling a country. And the only reason I say that is because of the stories I hear in my armchair in my office that leave me at the end of the day confused and traumatised.”
Bishop Verryn was joined in his church by several human rights advocates who have recently returned from Zimbabwe . They were shocked by what they saw.
Kumi Naidoo, a former anti-apartheid activist, says a lack of action by South African leaders has “betrayed an entire generation”.
He is one of a growing number of civic leaders who have been highly critical of the South African Government and its regional organisation the Southern African Development Community (SADC) for failing to intervene in the Zimbabwe crisis.
“The culpability and the responsibility cannot be left at ( Zimbabwe President Robert) Mugabe alone,” he said.
“It has to be shared right now by the leadership of SADC that has basically allowed Mugabe to get away with murder.”
Mr Naidoo is the honorary president the World Alliance for Citizen Participation. He says the situation has made him ashamed to be a South African .
“When people repeatedly say ‘How can you let us down, how can you abandon us, how can you tolerate abduction, torture, complete collapse of services?’ I felt ashamed as a South African not to be able to give an answer,” he said.
“And if we can tolerate it on our borders, then sadly it means we will tolerate it at home, and that would just be a betrayal of the history and legacy of the liberation struggle in this country.”
Bishop Verryn agrees with that assessment.
“The deep anxieties I have about my own nation is that it seems as if we have forgotten so quickly what it really feels like to be vulnerable,” he said.

The concerned gvts have not agreement with the Zim gvt for this kind of abuse of their currencies.
